TrendPay – Terms of Use

Welcome to TrendPay! These Terms of Use (“Terms”) govern your access to and use of the TrendPay mobile application and services (“Service”) provided by [Your Company Name/TrendPay].

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not use the Service.

1. About TrendPay

TrendPay is a dynamic platform connecting content creators with their audience across music and other content formats. The Service enables creators to monetize their content through ads, content sales, and direct support. Viewers can earn TrendPay Points, participate in interactive experiences, and personalize their experience with multi-profiles.

2. Access and Account

a. Account Registration:
To use certain features of the Service, you must register an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated at all times.

b. Multi-Profiles:
TrendPay offers a multi-profile feature, allowing users to create and manage individual profiles under one main login. Each sub-profile may have its own viewing history, preferences, TrendPay Points, and level progression. You are responsible for all activity under your account and all associated sub-profiles.

c. Security:
You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. You agree to immediately notify TrendPay of any unauthorized use of your account.

3. User Content

a. Creator Content:
As a creator, you may upload, stream, or otherwise make content available through the Service (“Creator Content”). You retain all ownership rights to your Creator Content.

b. License to TrendPay:
By making Creator Content available through the Service, you grant TrendPay a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit the Creator Content in connection with the Service and TrendPay’s (and its successors’ and affiliates’) business, including without limitation for promotion and redistribution of all or part of the Service (and derivative works thereof) in any media format and through any media channels.

c. Representations:
You represent and warrant that your Creator Content and your sharing and distribution of it through the Service do not infringe, misappropriate, or violate any third-party patents, copyrights, trademarks, trade secrets, moral rights, or other intellectual property rights, or rights of publicity or privacy, and do not violate any applicable laws or regulations.

d. Prohibited Content:
You agree not to upload, post, transmit, upload, distribute, or otherwise make available any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

4. TrendPay Points and Monetization

a. Earning Points:
Viewers can earn TrendPay Points by consuming content, participating in interactions (e.g., polls, emojis), watching ads through the “boost” feature, or by reaching certain levels in the app.

b. Using Points:
TrendPay Points may be used to purchase access to paid content, buy products on the marketplace, tip creators, or otherwise engage within the Service as specified in the app.

c. No Cash Value:
TrendPay Points have no cash value and cannot be exchanged for money or other currencies unless explicitly stated by TrendPay.

d. Monetization for Creators:
Creators may earn money through ad views, selling access to content (via TrendPay Points), selling products, and receiving tips from viewers. TrendPay reserves the right to determine terms and fees for these monetization models.

5. Marketplace and Rewards

a. Products:
Creators may sell physical and digital products through the TrendPay marketplace. All marketplace transactions are subject to these Terms and any additional creator-specific terms.

b. Rewards:
Creators may set up reward systems based on viewer engagement (e.g., views, watch time, likes, comments). TrendPay facilitates the tracking of rewards but is not responsible for the creator’s fulfillment of such rewards.

6. Prohibited Conduct

You agree not to:

• Use the Service for unlawful purposes.

• Interfere with or disrupt the Service or servers or networks connected to the Service.

• Attempt to bypass any security measures of the Service.

• Collect or harvest personal data about other users without their consent.

7. Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. TrendPay does not guarantee that the Service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

In no event shall TrendPay, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(i) your access to or use of or inability to access or use the Service;
(ii) any conduct or content of any third party on the Service;
(iii) any content obtained from the Service; and
(iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Changes to the Terms

TrendPay reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days’ notice before the new terms take effect.
